Very Tough Question

With other countries now doing what the French do and accepting foreign soldiers into their army, a serious question now emerges. Luckily we have not faced the problem yet, but one day we probably will.

Let's say and American was denied from the United States Military for whatever reason, so he goes to a foreign country, like France, and signs up for the French Foreign Legion thinking the United States and France will never go to war with each other. So he joins, goes through training, and becomes a French soldier, then returns to his home in the United States. 

Then a year later the worst thing happens, the French go to war with the United States. The French call upon the soldier to fight for them, against his own country.

1. Would the United States protect the person if he denies to go into battle on the side of the French?2. Even if he denies to fight for the French, could he still be kept as a war prisoner by the United States?

Ok, I am going to set up a senario, and I want you to tell me what you would do.

Scenario: You are president of the United States of America. One of your enemies has just launched four ICBMs (Inter-Contanental Ballistic Missile) at your nation. They were aimed for New York, Washington, DC, Fort Knox, and Langley Air Force Base. The only two missiles to hit land were the ones aimed for New York and Fort Knox. The other two dropped into the Atlantic ocean, and none of them were carrying a Nuclear Warhead. You learn the country behind this devistating attack, which killed 1,020 people and wounded over 3,000 is China. But China was not dumb, for years they built up their military, supassing your military. They also have over 1,000,000 more soldiers than you do, and have given bombs to all civilians in China, and spread propaganda that the Americans are man eating demons. And that the Americans will kill their children and sell the adults into slavery, and the only way to protect themselves is to blow themselves up and take American soldiers out with them. 

Aftermath: The civilians are outraged, but have no idea that China has nuclear weapons and advanced technology. You have positioned your military right off the coast of China. But China has positioned their advanced military around your military and on the coast of the United States. They threaten that by making one wrong move they will attack the United States with a full military assault. They demend that in order for them to back down, and to prevent all future attacks the United States must pay China a ransom of 1,000,000,000 dollars and must hand over the states of Alaska, Texas, Oaklahoma, California, New York, and Virgina. You know that they are mainly after oil and a front door to Washington, DC. Your people demand you risk everything, cast the die, and destory China. But then China raises the stakes and brings Korea, and Iran into the mix with their newly developed nuclear weapons.

Did you know that on top of the flag pole that is out infront of every government building (and ontop of the white house and on military bases) there is a ball. And the ball is made to break into 13 peices when dropped, to represent the 13 original colonies. And inside that ball you will find a book of matches, and a .45 caliber bullet. This is so the last standing officer can burn the flag, and load the last .45 caliber bullet into his pistol and shoot himself. The reason for this is because the United States officers have swore to defend the United States of America until they die. So During battle, if the base is being over run, the officer is supposed to use the book of matches to quickly burn the flag, to prevent the enemy from taking the flag and winning the war, and then he loads the last .45 caliber bullet into his pistol, and carries out his promise of defending the United States. The reason he kills himself is because American officers are not allowed to surrender a military base.
