I think that if gay people can prove that they are long-term domestic partners, even though they are not legally married, immigration service should look at it as a marriage.
If you are marrying US national right now, you are granted temporary green card good for 2 years and during this time you have to be with your spouse and at the end of 2 years you go for an interview with INS where you have to prove that during those two years you maintained your marriage. You could do the same checking for gay couples.

There are also a large group of gay couples who are both Americans who immigrate abroad too, just so they can live their lives freely.

Ironic how so many have to leave the so called 'land of the free' in order to truly be free and live their lives.
