It is neither a misdemeanor nor a felony to violate the mandate to stay home and not congregate issued by a politician. It is a minor infraction under the Public Health Law that only involves a fine and is only enforceable by the Attorney General of each State. Officers won’t engage or risk exposure for something out of their authority to act.

Not during a national emergency.

You’re wrong. Unless the state government has an actual penal law pertaining to this it is not enforceable by the police. It falls under the Public Health Law.

Any proof for your claim that Californian order for example is not enforceable as misdemeanor?

Will not be enforced in my state. Like I said, a state would need to have it specifically in their Penal Law but doubt any police dept. would ever try to enforce it. The Police Dept.'s across the nation barely have enough staff to manage their current calls for service let alone try to enforce a politicians mandate.

Trump should have implemented stricter social distancing rules a few weeks ago…2 family members out at one time, isolation apart from essential things like food shopping at designated times for the elderly… to try and stem the infection rate. Easter was always wishful thinking, everybody knew that and I have a feeling June/July may be a more realistic ‘aspiration.’

People can be warned all you want but they don’t listen. It didn’t stop the spring breakers at all.

They do not listen, you say?

If they won’t listen, at least the state has the monopoly of coercion to make them listen.

I don’t live in France and nothing stopped spring break from happening in the United States. Also, the state has virtually no legal teeth to make people listen to not congregate. In my city, the inner city life continues as normal with no mind to the virus.

These idiots have already learned their lesson:

Nothing can be done, are you sure?

People understand the language of fines and a misdemeanor crime.

The way things are looking, Trump is being far too optimistic.

New York should be put under strict curfew, the figures speak for themselves.
